Filed earlier this week, a customer claims that GameStop is misleading in the way they package products. Plaintiff James Collins' problems began when he purchased a used copy of Dragon Age: Origins in January. The game's box art advertised free downloadable content with the purchase of the game. When Collins attempted to access the content, he was shocked to find that it was only available to those who bought a new copy of the game and that in order to access it he would have to pay $15.
Collins claims that GameStop is tricking customers into buying used copies of games but not mentioning that free downloadable content only comes when the game is purchased as new. His contention is that this essentially tricks them into paying more than the cost of the game.
Collins is seeking restitution, interest from the sales of used games that were wrongfully obtained, and damages for fraud.
